Terms and Conditions

These terms and conditions define the rules for providing services conducted by the Service Provider at https://ServerProject.net. The seller is a company named JB Engineering Jakub Bilan, with its registered office at ul. Kłodzka 1, 63-400 Ostrów Wielkopolski, subject to entry in the Central Register of Business Activity, registered under NIP: 622-267-79-24, REGON: 362321360, also called interchangeably 'Service Provider'. § 1

  1. Terms and Conditions – these terms and conditions. In the scope of services provided electronically, the Terms and Conditions are the terms and conditions referred to in Art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144, item 1204 as amended).
  2. Client – a natural person, legal person, or organizational unit without legal personality but with legal capacity, which makes an Order for services on the terms specified in these Terms and Conditions.
  3. Consumer – a Client who is a natural person using services for purposes not directly related to their business or professional activity.
  4. Service Recipient - Client.
  5. Service Provider – an entity providing services through the website on the terms specified in these Terms and Conditions.
  6. Administrative Panel – a tool based on www interface used to manage the Service Provider's services.
  7. Agreement – an electronic agreement concluded through the Service Provider's Website between JB Engineering company and the Service Recipient.
  8. Website – an internet service available at https://ServerProject.net.
  9. Order – a declaration of will by the Client clearly defining the type and specification of the service, directly aimed at concluding an Agreement.
  10. IT system – a set of cooperating IT devices and software, ensuring processing and storage, as well as sending and receiving data through telecommunications networks using appropriate terminal equipment for a given type of network.
  11. Virtual Wallet – functionality of the Administrative Panel allowing to maintain a collection of virtual units called points.
  12. Points – virtual unit that can be exchanged for Services provided by the Service Provider.
  13. Server – computer software used to conduct games or communicate through the Internet.
  14. Slot – place on the server intended for one player.
  15. Registration – the process of creating an account in the Administrative Panel.

§ 2

  1. These Terms and Conditions define the rules for using services provided by the Service Provider's Website.
  2. A condition for placing an Order by the Client is familiarization with these Terms and Conditions and acceptance of its provisions during Registration in the Administrative Panel.
  3. Within the technical requirements necessary for cooperation with the IT system used by the Service Provider for placing and fulfilling Orders, the Client should have an active email account (e-mail) and a device connected to the Internet, meeting the following minimum technical requirements:
    1. web browser Mozilla Firefox version 34 or newer and Google Chrome version 39 or newer with cookies and JavaScript enabled,
    2. minimum screen resolution is 1024x768 pixels.
  4. The Client is obliged not to deliver content prohibited by law, e.g. content promoting violence, defamatory, or violating personal rights and other rights of third parties.
  5. Email correspondence between the Service Recipient and the Service Provider is considered as making a declaration of will within the meaning of Art. 60 of the Civil Code at the time specified in Art. 61 § 2 of the Civil Code.

§ 3

  1. The Service Provider ensures the efficiency of equipment and stability of the unmodified game server. Factors affecting incorrect operation of the game server may be:
    1. overloaded user connection,
    2. interference from the internet connection provider,
    3. incorrect server and/or game configuration by the owner/user,
    4. used software/server modifications.
  2. It is absolutely forbidden to change the number of slots to more than purchased or the port and IP address of the game server.
  3. The server name cannot contain various types of offensive words, in the case of a private server - its password.
  4. In the case of a private server with an access password, it is forbidden to remove and publicly disseminate the password allowing connection to the game.
  5. The Service Provider enables server administration through the Administrative Panel.
  6. It is forbidden to use the FTP server for storing files unrelated to server operation - this applies in particular to files covered by copyright protection.
  7. Uploaded modifications and changes to standard settings cannot cause deterioration of working conditions of other client servers (server modifications, configuration changes that cause above-standard load on the server machine) - in the event of such a situation, the Service Provider, after prior attempt to contact the Client, has the right to restore the server to standard settings, and in the case of re-setting the server in the above-mentioned mode reserves the right to suspend the server.
  8. It is forbidden to share the Administrative Panel account with third parties and to assign the account or servers to other persons without the consent and knowledge of the Service Provider.

§ 4

  1. All prices given on the https://ServerProject.net websites are gross prices given in Polish zlotys.
  2. Prices depend on the current market situation and are in accordance with the price list published on the https://ServerProject.net website.
  3. Orders are accepted through the Administrative Panel.
  4. Orders can be placed 24 hours a day, 7 days a week throughout the year.
  5. The order is effective if the Client correctly fills out the order form.
  6. The conclusion of the agreement occurs through sending the order form by the Client in the Administrative Panel.
  7. The conclusion of the agreement depends on the technical and legal capabilities of the Service Provider.
  8. The Service Provider has the right to terminate the agreement in the case of:
    1. providing incorrect or untrue data before concluding the Agreement,
    2. actions of the Service Recipient causing damage to the Service Provider's system,
    3. changes in service parameters that may significantly affect the stability and consumption of the Service Provider's hardware resources.
  9. The Service Provider undertakes to fulfill the order within one working day from the day of crediting their bank account.

§ 5

  1. The Service Provider, through the Administrative Panel, provides functionality called Virtual Wallet, allowing for collecting points and exchanging them for services.
  2. Funds paid into the Virtual Wallet are automatically converted to points at a ratio of 1 PLN = 1 point.
  3. Points accumulated in the Virtual Wallet are not subject to withdrawal.

§ 6

  1. A Consumer who has concluded a distance contract has the right to withdraw from the contract without giving reasons by submitting an appropriate written statement within 14 days. This period is non-extendable and is counted from the day of starting the service. To preserve this period, it is sufficient to send the statement before its expiry to the Service Provider's address.
  2. The provision from point 1. applies only to agreements in the performance of which the service is entirely provided by the Service Provider without the participation of a third party.
  3. Complaints should be submitted to the Service Provider's traditional postal address or email address [email protected].
  4. The Consumer declares that they have been informed that after the entrepreneur fulfills the service, they will lose the right to withdraw from the contract.
  5. The Service Provider is obliged to remove failures no later than within 5 working days from the date of informing the Service Provider by the Client about the occurred problem.
  6. In the case of incorrect operation of services due to the Service Provider's fault, they are obliged to extend the period of service operation by a period equal to its faulty operation.

§ 7

  1. Clients with an account in the Administrative Panel will be informed about changes to the Terms and Conditions via email correspondence.
  2. The Client accepts or does not accept its provisions after changes. In the case of lack of acceptance of the Terms and Conditions, especially after introducing its changes, placing orders in the Administrative Panel is not possible.
  3. Orders placed by Clients before the entry into force of changes to the Terms and Conditions will be fulfilled according to the previous provisions of the Terms and Conditions.

§ 8

  1. In matters not regulated by these Terms and Conditions, the provisions of the Act of March 2, 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws 2000 No. 22 item 271 as amended), the Act of July 27, 2002 on special conditions of consumer sales and on amendments to the Civil Code (Journal of Laws 2002 No. 141 item 1176 as amended), the Act of April 23, 1964 - Civil Code (Journal of Laws 1964 No. 16 item 93 as amended) shall apply.
  2. Disputes arising from the application of these Terms and Conditions and in connection with the performance of concluded agreements between the Store and Clients will be considered by the Court competent according to the provisions on subject matter and territorial jurisdiction in accordance with the Act of November 17, 1964 Code of Civil Procedure (Journal of Laws No. 43 item 296 as amended).
